California state law and MyChart access for minors
California law gives minors the right to access certain confidential care without a parent or guardian, including reproductive health, mental health, and substance use services. Because of this, MyChart proxy access changes as your child grows, and at certain ages your child must set up their own account and grant access to a parent or guardian themselves.
Below is what to expect and how to request proxy access at each stage.
What is proxy access?
Proxy access lets a parent or guardian view a patient’s MyChart account. Once a minor is old enough to consent to confidential care on their own, state law limits what a proxy can see or requires the minor to grant that access themselves.
Parent/guardian MyChart proxy access by age
Ages: 0-11 years old
- The child does not need an activated MyChart account.
- A parent or legal guardian may request and establish proxy access with their Tahoe Forest clinic provider.
Ages: 12-17 years old
- Adolescent must have their own activated MyChart account, ideally using their own email address. If they don’t have an email or account, the clinic can help set up access instead.
- Proxy access must be initiated by the adolescent from their own MyChart account. It cannot be initiated through a parent’s MyChart account or by calling the clinic. Once requested by the adolescent, a message is sent to the appropriate clinic pool for processing. A Tahoe Forest provider must establish the adolescent as a patient, and the required consent form must be completed and signed by the adolescent in the clinic before Proxy access is provided.
Ages: 18+ years old
- The patient has their own active MyChart account.
- Parent or guardian proxy access is established through the adult patient’s authorization/request process via MyChart. No clinic involvement is needed unless there is a diminished capacity.
Parent or guardian access at age 12
General health information
Remains the same with or without proxy access
Parents will continue to have access to general health information, such as immunizations, appointment reminders, and billing for their child, even if they don’t have access to the MyChart account as a proxy. Instead of using MyChart, they can obtain this information by:
- Calling the healthcare provider or facility over the phone.
- Submitting a request to access medical records through the appropriate channels.
Certain sensitive health information
Not available regardless of proxy access
Starting at age 12, parents/guardians may no longer have access to certain sensitive health information in MyChart. Examples of restricted information include notes or details about:
- Reproductive health
- Mental health
- Substance use services
Other health information
Requires proxy access
Visit notes, test results, and care details for conditions outside the restricted categories — such as urgent care or ER visits, injuries, illnesses, physical exams, and most prescriptions — are available through MyChart once proxy access is established.
